This Web site is owned and operated by
("EOS").
The use of this site is governed by the policies, terms and conditions set
forth below. Please read them carefully. Your use of this site indicates
your acceptance of these terms and conditions. Your placement of an order
indicates your acceptance of these terms and conditions. Your submittal
of any purchase order to EOS indicates acceptance of these terms and
conditions. These terms and conditions shall supercede any subsequent
terms or conditions included with any purchase order, whether or not such
terms or conditions are signed by EOS. EOS reserves the right to make
changes to this site and these terms and conditions at any time.
Typographical Errors. In the event a product is listed at an
incorrect price or with incorrect information due to typographical error
or error in pricing or product information received from our suppliers,
EOS shall have the right to refuse or cancel any orders placed for product
listed at the incorrect price. EOS shall have the right to refuse or
cancel any such orders whether or not the order has been confirmed and
your credit card charged. If your credit card has already been charged
for the purchase and your order is canceled, EOS shall immediately issue
a credit to your credit card account in the amount of the charge.
Order Acceptance Policy. Your receipt of an electronic or other
form of order confirmation does not signify our acceptance of your order,
nor does it constitute confirmation of our offer to sell. EOS reserves
the right at any time after receipt of your order to accept or decline
your order for any reason. EOS reserves the right at any time after
receipt of your order, without prior notice to you, to supply less than
the quantity you ordered of any item.
Warranty Exchange / Return Policy. EOS has made customer
satisfaction a top priority. Returns are accepted under certain
conditions. A valid return merchandise authorization (RMA) number must
accompany returns. Please request an RMA number by completing the RMA
Request Form located at http://www.EOS.com/rmarequest.cfm. This number
must be placed on the outside and inside of your returned product package
for adequate identification. Please be aware that prodcut returned
without a valid RMA number will be refused. Goods must be returned in
the original packaging with the manufacturers packaging materials and
manuals. If you do not have the original packaging, please explain why
in the notes section of the RMA Request Form. The warranty will be
voided on goods shipped in inadequate packaging. A copy of the original
invoice, with the description of the problem must accompany all returns.
An issued RMA number is valid for 30 calendar days from the issue date.
If goods are not received within 30 days, the RMA will be canceled.
Any goods shipped as advance replacement will be billed at the same rate
as the original invoice, including freight charges. Product returns must
be in the original condition as shipped from EOS, with no excessive wear
and tear, must have a valid RMA number, matching serial numbers with the
original invoice, received by EOS prior to the RMA expiration date. EOS
will, at its option, repair or replace the product in a timely manner
either internally or using a third party service representative.
Customers must make reasonable and timely attempts to assist EOS or its
service representative in repair or replacement of the product. Returns
must ship prepaid to the location specified at the time of RMA number
issuance.
Refund Policy. EOS maintains a 7-day refund policy. Customer may
return goods for a refund if EOS is notified within 7 days of receipt of
the goods. Restocking fee, explained below, may apply. Refunds are only
offered for defective or factory sealed items. 'Defective' means an item
is non-functioning, incompatible, or doesn't function as described or
advised by the manufacturer. 'Factory Sealed' means an item is in 100%
resalable condition, with all manufacturer's seals intact.
Restocking Fee. A 20% restocking fee plus freight to and from EOS
or its service representative will be assessed in the event of the
following circumstances: 1) In cases not involving a EOS error; 2) EOS is
not given the opportunity to repair or replace goods in a timely manner.
Freight Charges. In the event of a warranty repair or replacement,
EOS will pay UPS Ground equivalent freight charges to customer, and the
customer will pay for the return of the defective product. In the event of
an error by EOS, a call tag will be issued by EOS for pickup of the goods,
at the customer's location.
Damaged Goods. EOS is not responsible for damages incurred in
transit. It is the customer's responsibility to inspect shipment, and to
note any obvious damage with the driver. In the event of damaged goods,
the customer should immediately contact the freight carrier to place a
damage claim.
Warranty Limitations / Limitation of Liability. Except as stated
above, EOS makes no other warranties of any kind, express or implied,
including any warranty of merchantability or fitness for a particular
purpose with regard to the merchandise. Products which have been subject
to misuse, neglect, accident or modification, or which have been soldered
or altered during assembly and are not capable of being tested are excluded
from any warranty by EOS. EOS shall have no liability to customer or any
other person or entity with respect to any liability, loss or damage
arising out of or connected with the merchandise including, but not limited
to, any claim for incidental or consequential damages, regardless of any
warranty included with the merchandise. Please refer to the manufacturer's
or vendor's warranty included with the merchandise to determine the
remedies available in the event of a defect in materials or workmanship.
Some states do not allow exclusion of or limitations on implied warranties,
such as warranties of merchantability or fitness for a particular purpose
or the exclusion of incidental or consequential damages, so the above
limitations or exclusions may not apply to you. In addition, you may have
other rights which vary from state to state.
Manufacturers' Warranties. Many specific products offered on this
web site are covered by a manufacturer's warranty. A copy of a specific
warranty, where one is offered by a warrantor, will be made available for
inspection before sale, upon specific request. A copy of the warranty will
be mailed to you, or transmitted to any fax machine you designate.
